Often, citizens complain about a situation, which is not a city code violation, but have failed to give the Code Enforcement officers a way to advise them of such. The city cannot enforce deed restrictions unless they mirror city codes. Restrictive covenants are a contract between the homeowners in a specific area and the developer. The city is not a party to that contract. If you want your restrictive covenants enforced, first try your homeowners association. If one does not exist or they will not enforce the restrictions, any party to the contract has the right to go to the Justice of the Peace’s office and file a “Suit for Specific Performance.” The complainant must pay a filing fee and a fee for the Constable to serve the defendant. When the Code Officer investigates a complaint and find the complaint is valid, they take pictures of the violation and return to the Code Enforcement Office. The officer looks up the legal property to find the owner(s). If the property has not been in the complaint computer prior, then the Code Officer will send the property owner(s) a letter giving them 10 to correct the violation. In 10 the Code Officer will re-inspect the property.
If the violation has been corrected, the Code Officer will close the complaint in the computer. In the event the violation has not been corrected in the allotted time, the Code Officer will retake pictures and send the property owner(s) a citation, at which time they will 10 days to contact Municipal Court and pay the fines. Yes. The Senior Code Enforcement Officer is charged with the investigation of environmental crimes. The usual investigation involves illegal dumping of solid waste but can include hazardous wastes and materials. They also perform courtesy safety inspections when power is turned on at a house or business. The City of Big Spring Code of Ordinances allows your grass or weeds to reach a maximum of 12 before a letter will be sent to the property owner. The property owner has 10 to correct the violation. At the end of the 10 the Code Officer will reinspect the violation. If it has been corrected the complaint will be closed. A property owner must not allow their vegetation to grow into the city streets, alleys, or side streets. This can, and will create a safety hazard for traffic at intersections and in alleys. If a property owner allows their vegetation to enter into the public right of ways, the Code Officer will send the property owner a letter asking them to trim the trees or vegetation back. Under Article 3, Section 13-46 of the City Code of Ordinances, a motor vehicle is considered a junk vehicle if it does not have lawfully attached to it:
- An expired license plate and sticker
- A valid motor vehicle inspection certificate
- Is wrecked, dismantled or partially dismantled, or discarded
- Remains inoperable for more than 45 consecutive days
A certified letter will be sent to the property owner(s) to remove the vehicle(s) from the property. After the 10 a reinspection will be done by the Code Officer. If the violation has been corrected the complaint will be closed. If the violation still exist a citation will be sent to the property owner(s), for every day that the violation occurs. If you see a crew flushing a hydrant on your street, avoid running tap water and using the washing machine or the dishwasher until the flushing is completed. If you see hydrant-flushing crews working in the area, please drive carefully and treat them like any other road construction crew. -If tap water is used during flushing, it could come out full of sediment that causes discoloration. If you encounter discolored water, shut the water off and wait several minutes. After waiting, check the clarity by running cold water for a few minutes allowing new water to work its way into your pipes. If the water is clear it’s OK to use. If not, wait a few more minutes and check again. In some cases, there may be slight discoloration for a few hours. This discoloration only affects the appearance of the water; it does not affect the taste or water quality.Hydrant Flushing
-Avoid washing laundry during scheduled flushing times. Wait until the water runs clear at the tap, then wash a load of dark clothes first. Hot water tanks can hold discolored water for some time after the cold water runs clear.

When a hydrant is opened, there will be temporary incidences of discolored water while fine sediment particles are flushed out. There is no health hazard associated with the discolored water. Allow a few hours for discoloration to dissipate. To verify water is clear, run your cold-water tap for a few minutes. The BSFD is a dual department; all of our personnel are trained and certified in both fire suppression and emergency medical services. The BSFD routinely sends a fire truck to assist ambulances because each ambulance only has two personnel on board. This procedure allows a minimum of four personnel on scene to assist with patient treatment, lifting, and loading. Flowing of hydrants is a vital function and is required by the Insurance Service Organization (ISO). The ISO sets the classification of our fire department in addition to determining homeowner’s insurance rates. Flushing hydrants allows the department to verify that each hydrant has sufficient water pressure to provide adequate fire suppression flow for that area. It allows us to detect and repair any deficiencies in the water system before it is needed for a fire. It also allows us to flush out any debris or other substances that are in the water lines. This is a very good question that could have many answers. First of all, there is a steady influx of new employees at the BSFD. As part of the initial and on-going training, new firefighters are required to learn how to safely operate both the ambulances and fire units. The best way to accomplish this is to allow them to operate these vehicles under direct supervision of a more experienced firefighter. Secondly, the firefighter may be learning a particular part of town by driving that area to familiarize themselves with the streets, dips, curves, etc. Lastly, the department performs periodic checks of fire hydrants throughout town. This includes checking hydrants for damage, paint condition, location, etc. Citizens can rest assured that all units are available for immediate response to an emergency, if needed. One of the department's many responsibilities is to perform pre-fire plans and safety surveys for our local businesses. We routinely go out to local businesses to assess the building, familiarize ourselves with the layout, and make recommendations to help prevent fires and safety issues. If you are charged with a traffic offense, you may be eligible to ask the judge to take a driving safety course to dismiss the charge. The request must be made before the appearance date on the citation. It may be made in writing. If you were operating a motorcycle and request to take a driving safety course, you must take a motorcycle operator’s training course. At the time of the request, you must do the following:
- Present proof of financial responsibility (liability insurance) and valid Texas Driver's License
- Plead guilty or nolo contendere (no contest)
- Pay court costs and an administrative fee, if required
The case will be postponed for 180 days to allow you time to complete the course. You must attend a driving safety course that has been approved by the Texas Education Agency or a motorcycle operator’s course approved by the Department of Public Safety. You must present a certified copy of your driving record from the Department of Public Safety that shows that you have not had a driving safety course within the 12 months (Requests for certified Driving Records may be made to: LIDR, Texas Department of Public Safety, Box 15999 Austin, TX 78761-5999) and swear to an affidavit that you are not currently taking a driving safety course and that you have not taken one that is not shown on your driving record.Municipal Court
If you do not take the course in the time required and/or fail to present the court with a certificate of completion, the court will notify you to return to court and explain why you failed to show proof of completion. If you have a good reason why you were unable to present your proof within the time required, the judge may, but is not required to, grant you an extension. The municipal court has jurisdiction over juveniles (16 years or younger) charged with Class C misdemeanor offenses except public intoxication. All juveniles are required to appear in open court for all proceedings in their cases. The parent of a juvenile charged in municipal court must be present in court with their child. Juveniles who fail to appear in court may have an additional charge of failure to appear filed against them. Juveniles who fail to appear or who fail to pay their fine will be reported to the Department of Public Safety who will suspend or deny issuance of a driver’s license. This will not only help in your decision making process, but also may save time and money by avoiding potential non-compliance with various City Codes and Ordinances. - Any owner, authorized agent, or contractor who desires to construct, enlarge, alter, repair, remove, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical, or plumbing system, the installation which is regulated by the technical codes, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit for the work. Minor repairs may be made with the approval of the Building Official without a permit, provided that such repairs shall not violate any of the provisions of the technical codes.

Yes, a permit is required to re-roof your house. The standard permit fee is $25 for the first $3,000 dollars. If you are a commercial contractor, then landfill fees will apply. Yes, a permit is required for the removal and installation of all water heaters and storage tanks do require a permit. This will ensure that pressure and temperature valves, gas vents, gas valves, gas lines, and drain lines are installed properly. On electric water heaters, a permit will ensure that the wire size and breakers are of adequate size as per Plumbing and Electrical Code. If you want to exceed your building line setbacks, you must make application to the Building Official. The application will be denied and at that point a meeting will be set for the Zoning Board to review the application. The cost for the meeting will be $50.
